WASHINGTON – Buying or selling a home? Better get used to the concept of as-is.

The Greater Capital Area Association of REALTORS (GCAAR) and the Northern Virginia Association of REALTORS (NVAR) issued a revised contract for many home sales in Maryland, D.C. and Virginia, starting Jan. 1, 2012.

bUPDATE:/bi WTOP has learned that not all homes in Maryland will be sold as-is from now on.

The change only impacts homes sold in locations which use the regional contract: Northern Virginia, D.C. and much of Montgomery County.

However, the rest of Maryland falls under the Maryland Association of REALTORS (MAR) contract, so counties such as Prince George’s or Charles won’t have to abide by the new rules which say homes are sold as-is.

It will be business as usual, meaning sellers will have the obligation to ensure that everything mechanical and electrical in the home is in proper working order.

It means assumptions a buyer once could make no longer exist.
/pp
Up until now, a buyer could assume that the heating, cooling, washer/dryer and anything mechanical or electrical was working in the home properly when it’s time to move into it.

Not anymore.

The entire house is sold as-is, explains Eldad Moraru of Long and Foster. The seller has no obligation to ensure that anything is in normal working condition. Now it’s all negotiable.

What does that mean?

Moraru says it puts a greater pressure on the buyer to determine what they want fixed in the home prior to a sales contract. And Moraru says more importantly than ever, buyers need a good home inspector.

Buyers will use the frisco home inspection to determine what they want addressed or fixed in the home. Sellers then have the option of agreeing to the fixes, negotiating some of the fixes or offering money to the buyer to make the improvements themselves.

Does the change put the ball in the court of the seller?

One would argue it benefits the seller — I’m not convinced, says Moraru. He thinks the change will make things clearer and more transparent for both buyers and sellers of homes.

/ppJoseph Tharpe, 29, has been gainfully employed – by others – for the past 15 years. But during all of that time he was looking ahead to the day when he could open his own business.
/ppTharpe dropped out of high school at age 16 to help support his ailing mother. It’s been an adventure ever since.
/ppI felt I had to help my mom, as a single parent she had taken care of me, Tharpe said. So working is just something I’ve done. My mom had diabetes, and eventually passed away. But then I got married so I just kept on working. I never really had the time or the finances to go back to school.
/ppTharpe and his wife Heather held a series of jobs, but none that really sparked their interest.
/ppIt just seemed like we were in dead-end situations, Joseph Tharpe said. And we both wanted an occupation where we were our own boss.
/ppWe spent a lot of time researching what was out there, and finally decided that getting a franchise in Pillar to Post was the way to go. We both went through their training, which was really intensive, and, on Dec. 1, we opened for business.
/ppPillar to Post is one of North America’s leading frisco home inspection companies. The Tharpes’ franchise stretches from San Gabriel to Burbank.
/ppHeather Tharpe currently works for a florist. She admits the change from flowers to floorboards is a bit out of her comfort /pzone.
pI would have been worried except that Pillar to Post’s training sessions were really, really thorough, she said. They have a great support system in place.
/ppHer only concern, she said, is that the couple only has one set of tools. But she figures that will soon change.
/ppA frisco home inspection company seemed pretty much recession-proof, Joseph Tharpe said. People are going to need our services, and with all the homes changing hands right now in Southern California home inspectors are more in demand than ever. Personally, I don’t know why anyone would buy or sell a home without getting it inspected by an independent party.
/ppThe majority of the Tharpes’ clients will be real estate companies, although private parties can also contract for their services.
/ppNeither Tharpe has a background in construction, but both feel the training provided by Pillar to Post, along with a large dose of common sense, should make their franchise successful.
/ppI do have a background in the automotive industry, so there is some mechanical ability there, Tharpe said. The biggest thing is you need to pay attention to what you are doing. With frisco home inspection you have to consider all aspects of the home, from plumbing to electrical to the structure.
/ppTharpe figures the new venture will be exciting becaue every home is different, and so every job will be different.
/ppThe way the deal works, whether we are hired by the real estate company, the buyer or the seller, we are unbiased in our report, he said. It’s really like being detectives, looking for anything that’s not right.
/ppWhen we are finished we prepare a written report. The means we put our work on the line, which is the way it should be. Obviously, if we miss things we going to lose customers.
/ppI guess the only drawback is that you’re going to get dirty. Then again, working around cars is pretty dirty business so that’s nothing new to me.
/ppAlthough the Tharpes’ just opened for business, they have four or five jobs already lined up.
/ppPillar to Post does a great job of contacting real estate companies, so it looks like we are going to be real busy real soon. And that’s exactly what we have been looking for.
/ppI finally have something that’s not just a job, it’s a career. I’m my own boss and I get to work with my wife. That’s the American dream come true.
