I set to close on the 15 of Jan(in California) on a short sale. Realtor cannot get a hold of seller if the seller does not show up can i get out of deal. The bank for short sale gave until 21 of January to close. In addition i made the mistake of not doing an inspection the first 17 days, waited until closing and there are problems with the foundation being uneven(told it need an engineer to determine extent) bottom line can i get out if not signed by the 15 or the date given by the bank on the 21 without losing my earnest money.

De lijstprijs was de $131.900-toegelaten aanbieding was $134.000 (met hen die betalen $5000 naar mijn het sluiten kosten) ik weet de ruimte ik moet bespreken op de geschatte reparatiekosten zal worden gebaseerd maar hoeveel meer ik met hen kunnen onderhandelen? Originele prijs (1997) 96.500, denk ik zij refi' D of gekregen een huisgelijkheid in 2005 voor $112.500. (Austin, Gebied TX). The “person” buying my home wants $12,000 in repairs (largest items: Radon Remediation (we are at a 4.6) $3000, a Chimney Liner ($3000), and … they are claiming there is POSSIBLE Asbestos inside our ductwork ~ it’s non-visible for $3500 (we had a company come out ALREADY and remove Asbestos, for $4000, and issue a Clean Air Certificate. They claim there may be more, they missed?!?) Our Attorney is giving us the impression that these items aren’t negotiable (we know the Radon isn’t). We always thought this part of the process WAS negotiable? Any thoughts?!? o I’m in Princeton, NJ. o Of course I’m aware of the market … we are already selling for $135,000 less than we started. o 4.6 is not bad, 4.0 is allowed. o Great idea on having them prove the asbestos (re-test). o Yes, code now requires a Chimney Liner. Fireplace works great ~ masonry. o We’ve already spent $4000 (to remove asbestos ductwork & furance) ~ they want an ADDITIONAL $12,000.

Can a buyer back out of a purchase agreement with a home inspection even if the inspection showed nothing?

We recieved an offer on our house and signed the purchase agreement immediately. The purchase agreement was contingent on an inspection. 2 days later, the buyers wanted to back out because they found a house for less money. Our realtor tells us there is nothing we can do because the buyers can just complete the inspection and cancel at that point. Even if the inspection is perfect. Is this true? Do we have no alternative than to let them back out? We have not signed any type of cancellation of purchase agreement yet? Does that even exist? What is most frustrating is that had we recieved a better offer in those two days, we would have been out of luck.
Thank you to everyone who answered so far. Although I didn’t necessarily get the answer I had hoped for (I wasn’t expecting to), it makes me feel better to know that we are not giving up too easily.

What’s the best way to negotiate a home inspection into the final sale price when purchasing a house?

We’re not sure we can trust the seller to make quality repairs should any faults be found. Can we some how negotiate a lower sale price so we can do a good quality repair ourselves? Should we have a contractor walk through the house with us and present the estimates at the time of closing? The inspection is happening this week and closing is scheduled for the end of the month. We’ve already noticed a drippy ceiling coming through a central heating vent. Plus a 126 sq ft back porch is incomplete and really needs to be demolished and rebuilt. The back yard doesn’t drain too well either. Many puddles and soggy areas still present after our second walkthrough five days later. It has a nice garden area but we don’t want to grow rice if you know what I mean. Major sections of the roof have no gutters and the carport roof lacks a significant pitch (just so happens to be the same room with heater vent leak). Backyard spotlight looks like it’s attached to an extension cord and taped up with electrical tape. We’re already getting an ok deal but and additional 5 to 8 thousand off would definitely make the deal so much better as we would hope to keep repairs and modifications under $10,000. Welcome your advice and website links. Other useful info for you…It’s a rancher with an aluminum roof covering the main living space. The carport is attached to house and converted to a big living room / dining room space.

Our offer is already approved. Now we’re awaiting the inspection and will be there for that. The contract is written to say all repairs must be done by seller before closing, or if the inspection looks bleak we have the option of walking…

The house we are buying is overall in good condition. But the heating pump is old and may go in a couple years. Right now it dysfunctions and makes a noise too. There are various leaks in pipes, and on the roof, and some trip hazards with unleveled sidewalks to name a few things found in inspection.
We basically gave these people full asking price within a couple thousand dollars in this depressed market. Our agent seems almost like she wants to ask for repairs but not go overboard. We really want this stuff fixed because if we want to resell in a few years we don’t want to have to fix it, and we are not handy. Also, if they say they won’t fix the things we request, can we opt out of the purchase?

We are buying a home, we’ve already had a home inspection. And remedy has been made, what is the next step? We have a buyers agent, and we are supposed to close some where around the 5th of June. When would our “walk through” be? The day it be the day before closing or earlier? Thanks in advance.
